Apple Sued By Microware Systems Over Mac OS 9

according to a MacWEEK article. MS's operating system used in embedded devices, including those using the PowerPC chip, is called OS-9. It is actually called "Enhanced OS-9 for PowerPC v1.3" in this May press release. This is a far cry from a personal computer operating system called Mac OS 9. MS will have real difficulty showing actual damages from trademark dilution or consumer confusion. In fact, I suspect that Apple choosing to name its next Mac OS (Sonata) "Mac OS 9" would if anything enhance MS and certainly not damage it. Coming on the heels of Apple's cash reserves and stock hitting an all time high, doesn't this suit smell fishy? Well, it has been discussed as a possibility for some time. Maybe Apple will release Mac OS 9 as "Mac OS 9.0"--would that be different enough from "Enhanced OS-9 for PowerPC v1.3" for MS?
