[Update] From the Dark Side--DOJ Posted 47 "Major" Comments on Microsoft Antitrust Proposed Settlement on the Justice Department's web site. All of our points are included among the selected commenters (mostly lawyers, law professors, IT companies and IT professionals) and then some. Here are the summary points from our comments filed with DOJ on December 17:

• the settlement does not in anyway compensate for the effects of Microsoft's illegal maintenance of a monopoly
• it forecloses further pursuit of illegal tying
• its attempt to prevent future illegal monopolistic behavior is inadequate.

Only 5 of the 47 are supportive of the proposed settlement. All 30,000 comments and replies will be posted as PDF files on DOJ's web site by February 27th. [Dana Baggett]
