Remember that M$ CEO Steve Ballmer was quoted as stating that he doesn't even know what a monopoly is after M$ was convicted of illegal monpolistic practices? That unrepentant and totally stupid statement by the person who runs M$ in the face of an excess of 90 per cent share of the PC operating system market and convictions is reflective of why the Justice Department settlement is woefully inadequate. M$ will likely try to shirk on every requirement that gets in its way. In closing arguments today, M$ refused to budge while the non-settling states said that their most important remedy was to require sharing Windows' code with competitors so that their software ran as well as Microsoft's on Windows. We are not sure if the states' remedy extends to disclosure of file formats, but that is one point for which the open source community has been arguing. [Dana Baggett & Paul Martin]
