From the Dark Side--It's 2:1 Against M$/Justice Antitrust Settlement

The Joint Status Report was filed yesterday in response to Judge Colleen Kollar-Kotelly's January 29th order. The report provides a gross summary of the public comments filed November 28 to January 28 on the proposed settlement. Here are the salient points:

    - 30,000 public comments were filed, a huge response by past standards

    - 15,000 opposed the settlement and 7,500 supported it; 7,000 did not state a position

    - only 2,900 comments raised substantive issues in stating their opposition or support

    - 2,800 comments were form letters or emails or were essentially the same response

    - DOJ found 45 different "major" comments among the 30,000 commentors

    - DOJ proposes to post the comments and responses on their web site rather than pay $4 million to print them in the Federal Register as the Tunney Act requires; CDs will be available at cost

    - DOJ responses to the comments will be posted by February 27th

    - DOJ/M$ are contemplating the public comments and any proposed changes to the settlement will be submitted by February 27th

    - DOJ/M$ requested a short hearing be restricted in participation to the parties and limited to one day during the week of March 4th
