Commentary--iPod nano Owners Sue Apple Over Scratches

Well, well, well...it was only a matter of time. According to Red Herring, a class action lawsuit has been filed against Apple by some consumers who claim their iPod nano easily scratched to the point where it became unreadable. They demand a refund, statutory and punitive damages, attorneys fees and a share of the nano's profits, no less. Apple's stock closed up $1.20.

We quickly checked our long-term test nano being used by an unofficial Macs Only! staffer. It has been in and out of pockets and purses without a case and it's no more scratched than it was the last time we checked and no more than we would expect with such treatment. Gee, its even perfectly readable! We hope such lawsuits do not make Apple include one of those inane warnings such as "Do not use Brillo or sandpaper or a rasp to clean your nano of fingerprints and smudges.
