From the Dark Side--Appeal of M$ Anti-trust Settlement Far From Slam Dunk for M$ and the Federal Government

according to opening proceedings as reported by this AP article on Excite News. [Dana Baggett] The U.S. District of Columbia Court of Appeals is hearing the appeal by Massachusetts, the only state to not chicken out of the anti-trust suit and accept a minimal monetary settlement from Microsoft, joined by two trade associations, the Computer and Communications Industry Association and the Software and Information Industry Association.

Readers may remember that we took considerable issue with the settlement, mainly that it allowed the convicted illegal monopolist to keep all of its ill-gotten gains with no punishment whatsoever, would not prevent Microsoft from bundling its non-Windows OS software and is, for the most part, not enforceable. It is just lots of smoke and joke and legal gobbledegook.
